Opus Law Represents B in Death Case Brought 12 Years After Initial Crash
Ben Jones, Director, acted for B in this most difficult and emotional of cases where a charge of Death by Dangerous Driving was brought over 12 years after the date of the original crash, and almost 11 years since he was first sent to custody for the same incident.
The defendant was involved in a horrific collision in November 2006. This led to a child receiving life changing injuries. In April 2008 the defendant received a custodial sentence for dangerous driving.
Sadly, the child died as a result of her injuries in October 2015. The CPS informed us they were considering further charges and we set about making representations on our clients behalf to both the CPS and the Attorney General who had to authorise such a charge given the extensive delay.
Charges were brought and our client pleaded guilty. We presented a detailed and comprehensive mitigation bundle for the court to represent he changes in our client in the intervening decade. This enabled us to obtain the best possible sentence for our client.
