Ben Jones was instructed to represent C, an ex –professional footballer who had been a Steward at a Working Mens Club for 25 years following his retirement from the sport.

 

Following the appointment of a new committee complaints were made to the police which resulted in C being charged with three offences under Section 4 of the Fraud Act 2006- charges of fraud by abuse of position. This was a difficult case which required an in depth knowledge of the alcohol trade and the service of alcohol. The allegations made were very specific and related to ullage/wastage, the operation of a happy hour and misappropriation of monies.

 

A forensic accountant, Mr Tim Keeling, of Forths Forensic Accountants was instructed as he had previously served many years in the pub trade. Following extensive preparation and industry, documentation was served upon the Crown which caused a full review of the case and finally no evidence being offered in open court. Not guilty verdicts were therefore recorded.
